Too Big to Fail Strikes Agriculture


GIPSA is in the process of issuing new rules to regulate the marketplace. The proposed rules would have only a modest effect on a firm like Eastern, but they have drawn the ire of big players in the cattle, hog, and poultry industries. The biggest packers and producers call the proposed new regulations “draconian” and claim they will “set the meat industry back 50 years.”
 

OCM’s General Counsel, David A. Domina said: “Too big to fail is simply not working; too big to fail is a failure in and of itself. The collapse of this massive firm is going to be devastating to thousands of cattlemen, sale barns, truckers, ranch hands, and many others. Domina, Taylor File Final USDA/USDOJ Comments
on Fair Market Rules

 

Economist C Robert Taylor and David A Domina filed their Final Comments on the GIPSA proposed rules to reinvigorate the marketplace for cattle, hogs and poultry.  Domina and Taylor's prior work on Market Concentration has been cited in national and international publications.  They delivered  a rebuttal to the U S General Accounting Office report to the U S Congress a year ago. US Supreme Court Considers Petition for Writ of Certiorari

 

The United States Supreme Court has a Petition for Writ of Certiorari, co-authored by David A. Domina with three other lawyers, under consideration.  The Court will decide whether to review a Sixth Circuit decision against a poultry producer, Alton Terry.  Mr. Terry sued Tyson Farms, Inc., because a poultry processor refused to honor his request to be present when his birds were weighed to determine the amounts owed him. Read full story...
